Phil Tunley and Jennifer Saville Successfully Defend Disclosure Motion

Phil Tunley and Jennifer Saville successfully defended a motion seeking disclosure from the Ontario Energy Board.  In Rogers Communications Canada Inc. et al v The Ontario Energy Board, the Associate Chief Justice dismissed the appellants’ motion for disclosure entirely on the basis of relevance, applying a test derived from Harwig and CCSAGE as to whether the documents requested appear to be required for “meaningful judicial review” of the impugned decision.
