Phil Tunley and Jennifer Saville Represent Vice Media and Ben Makuch at Supreme Court

Phil Tunley and Jennifer Saville, along with co-counsel Iain MacKinnon, appeared before the Supreme Court of Canada representing Vice Media Canada and journalist Ben Makuch in a case demanding protection for journalistic source information. For the first time, the Court was asked to address the issue of access by police to unpublished communications between a journalist and a source. Vice and Makuch were supported by numerous media organizations intervening at the hearing. After lengthy oral submissions, during which Tunley told the Court that the media must not be turned into the investigative arm of the police, the Court reserved its decision.
