Alexi Wood Successfully Defends Appeal of Ontario Energy Board Decision

Alexi Wood, on behalf of the Ontario Energy Board, is successful in securing a dismissal of an appeal from a decision of the OEB regarding the interpretation of statutory provisions governing the assessment of certain pipeline facilities. In Tribute Resources Inc. v. Ontario Energy Board, the Divisional Court affirmed that the applicable standard of review was reasonableness. The Court upheld the OEB’s decision, finding that the OEB’s reasoning on the interpretation of the statutory provisions in issue was intelligible, justifiable, and transparent, and that the OEB’s factual findings were entitled to deference on appeal.
