Phil Tunley Successful in Resisting Motion for Leave to Appeal from a Decision of the Ontario Energy Board

Today the Ontario Court of Appeal dismissed a motion by various telecommunications carriers for leave to appeal a decision of the Ontario Energy Board setting a rate to be changed for attachment of telecommunications cables to electricity distribution poles owned by Hydro One Inc.  The decision is the latest in a series of decisions of the Divisional Court and Court of Appeal in which Phil Tunley acted for the Ontario Energy Board, upholding similar pole attachment rates proposed by Ottawa Hydro and Hydro One.
